All penetration testing, vulnerability assessment, and offensive security techniques demonstrated or facilitated by TaskCoda require explicit written authorization from the target system owner. Unauthorized use is illegal and will be reported to law enforcement.
Acceptance of Terms
By accessing or using the TaskCoda Security platform, website, documentation, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Services.
We reserve the right to modify these terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email to active clients.
You must be at least 18 years of age and have the legal authority to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
Authorized Use Only
ALL penetration testing, security assessment, vulnerability scanning, exploitation, and offensive security activities conducted using TaskCoda tools, techniques, or methodologies REQUIRE prior written authorization from the system owner. This is non-negotiable and applies without exception.
Every authorized engagement must have a defined scope document specifying target systems, IP ranges, testing windows, and emergency contact procedures. Testing outside the agreed scope is strictly prohibited and constitutes a violation of these Terms and applicable law.
You are solely responsible for ensuring your use of the Services complies with all applicable local, national, and international laws, including the Computer Fraud and Abuse Act (CFAA), the UK Computer Misuse Act, EU Directive 2013/40/EU, and equivalent statutes in your jurisdiction.
Using TaskCoda Services to scan, probe, exploit, or assess systems you do not own or have explicit written permission to test is a material breach of these Terms and may constitute criminal activity. TaskCoda will cooperate fully with law enforcement investigations of unauthorized use.
Prohibited Uses
You may not use the Services to: attack systems without written authorization; disrupt, degrade, or disable services for any third party; develop, distribute, or deploy malware, ransomware, or destructive payloads; conduct mass automated scanning of internet infrastructure; circumvent authentication on systems you do not control; engage in any activity that constitutes a crime under applicable law.
You may not misrepresent your identity, authorization status, or the scope of any engagement. Submitting false authorization documents or impersonating authorized personnel constitutes fraud and will result in immediate account termination and referral to law enforcement.
You may not resell, sublicense, or redistribute access to the TaskCoda platform or its outputs without a separate written agreement. Engagement reports are confidential and may not be shared with third parties without client authorization.
Client Responsibilities
You are responsible for providing accurate engagement scoping information. Errors in scope documents that result in unintended testing are the client's responsibility.
Penetration test reports contain sensitive vulnerability information. You are responsible for storing, transmitting, and disclosing reports securely and limiting access to personnel with a legitimate need to know.
TaskCoda provides findings and recommendations. You are solely responsible for implementing remediation. TaskCoda does not guarantee that following recommendations will eliminate all security risk.
Intellectual Property
The TaskCoda platform, including all software, methodologies, report templates, tooling, and documentation, is the exclusive intellectual property of TaskCoda Security Inc. Nothing in these Terms transfers ownership of platform IP to the client.
Engagement-specific deliverables (reports, findings, custom scripts developed for your engagement) are licensed to you for internal use. TaskCoda retains the right to use anonymized, aggregated findings for research and product improvement.
Any feedback, suggestions, or ideas you provide about the Services may be used by TaskCoda without restriction or compensation.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TASKCODA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL VULNERABILITIES IN YOUR SYSTEMS WILL BE DISCOVERED.
A penetration test or security assessment is a point-in-time evaluation. TaskCoda does not warrant or guarantee the ongoing security of your systems following an engagement. New vulnerabilities may emerge at any time.
The Services may integrate with or reference third-party tools. TaskCoda makes no warranties regarding third-party software and is not responsible for third-party tool behavior or vulnerabilities.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASKCODA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TASKCODA'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TASKCODA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless TaskCoda Security Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or unauthorized testing activities.
Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which TaskCoda Security Inc. is registered, without regard to conflict of law provisions.
Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under applicable arbitration rules. Class action claims are waived.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
